Is it necessary for my friend to get a lawyer to determine if he will be using copyrighted material?

A close friend of mine is a magician, and with the release of the new movie “The Prestige” there is a line they use to promote the movie, as well as in the movie itself “The Pledge, The Turn, and The Prestige”… He is interested in using these titles to promote a commercial magic act. I wouldnt think it would be a problem, but he might want to check this site out
The issue won’t likely be copyright, but rather Trademark infringement. And it’s not a question that can be answered without a detailed investigation of the material he wants to use.
